Terms of Sale

1. Purpose

These Terms of Sale govern the relationship between the Surf & Camp platform and users (hereinafter "guests") in connection with bookings made through the website surfandcamp.com.

Surf & Camp is a marketplace platform that allows guests to discover, compare, and book stays offered by independent surf camps (hereinafter "hosts").

2. Role of the Platform

Surf & Camp acts exclusively as a technical intermediary. The platform is not a party to the service contract between the guest and the host.

Accordingly, any booking constitutes a direct contract between the guest and the surf camp. Surf & Camp facilitates the connection and payment processing but is not the provider of the booked services.

3. Surf Camp (Host) Responsibilities

Each surf camp listed on the platform is an independent professional, solely responsible for:

  • Service deliverythe host commits to providing the booked services (accommodation, surf lessons, meals, etc.) as described on the platform.
  • Invoicing gueststhe host is responsible for issuing invoices for the services provided, in compliance with the regulations applicable in their country.
  • VAT and tax obligationsthe host is solely liable for any applicable VAT on the services sold and for all their fiscal and social obligations.
  • Compliance with local regulationsthe host must comply with applicable laws and regulations in their country of operation (licences, insurance, safety standards, etc.).
  • Accuracy of informationthe host guarantees the accuracy of the information published on their listing (descriptions, photos, pricing, availability).

4. Platform Responsibilities

Surf & Camp commits to:

  • Providing a functional and secure booking platform.
  • Processing payments securely through Stripe, in compliance with applicable standards.
  • Providing customer support for platform-related enquiries.

5. Booking Process

  1. The guest selects a surf camp, chooses their dates, and submits a booking request.
  2. The host reviews the request and may accept or decline it.
  3. If accepted, the guest receives a payment request and proceeds with the online payment via Stripe.
  4. Once payment is confirmed, the booking is validated and both parties receive a confirmation.

6. Payments and Commission

Payments are processed securely by Stripe. The process is as follows:

  • The guest pays the full booking amount at the time of payment.
  • Surf & Camp retains a 15% commission on the total amount of each booking, as a service fee for the platform.
  • Stripe processing fees (typically 1.4% to 2.9% + €0.25 to €0.30 depending on card type) are applied by Stripe.
  • The remaining balance is automatically paid out to the host's Stripe account.

By signing up on the platform, the host acknowledges and accepts these commission terms.

7. Cancellation and Refunds

Cancellation terms are defined by each host and are available on the listing page before any booking is made.

If a cancellation is eligible for a refund, it is processed via Stripe. Refund timelines depend on the guest's bank (typically 5 to 10 business days).

Surf & Camp is not responsible for disputes related to cancellations between the guest and the host.

8. Limitation of Liability

Surf & Camp shall not be held liable for:

  • The quality, conformity, or safety of services provided by hosts.
  • Any direct or indirect damages suffered by the guest during their stay.
  • Disputes, claims, or disagreements between the guest and the host.
  • Inaccuracies in information published by hosts on their listings.
  • Temporary website interruptions for maintenance or technical reasons.

9. Governing Law and Jurisdiction

These Terms of Sale are governed by French law. Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the courts of Marseille, France.
